Introduction: Scheduled Areas are specific regions in India identified by the President under the Fifth Schedule of the Constitution, aimed at protecting the interests of tribal communities. These areas are characterised by social and economic backwardness, a predominantly tribal population, and distinct cultural identities.

Key Features of Scheduled Areas under the Fifth Schedule

  1. Presidential Notification: The President of India has the authority to declare an area as a Scheduled Area and modify its boundaries.
  2. Governance Structure: The Governor of the state has special powers to make regulations for the peace and good governance of these areas. This includes the power to prohibit or restrict the transfer of land and regulate business activities.
  3. Tribal Advisory Councils (TACs): Each state having Scheduled Areas must constitute a Tribal Advisory Council to advise on matters pertaining to the welfare and advancement of Scheduled Tribes.
  4. Panchayats (Extension to Scheduled Areas) Act, 1996 (PESA): Extends the provisions of the 73rd Constitutional Amendment to Scheduled Areas, ensuring greater self-governance through Gram Sabhas and Panchayats.
  5. Special Funds and Schemes: Central and state governments provide special financial assistance and development schemes tailored to the needs of these areas.
  6. Protection of Tribal Land: The law provides safeguards to prevent the alienation of tribal land to non-tribals and seeks to restore illegally alienated lands to the original tribal owners.

Issues Pertaining to Scheduled Areas

  1. Inadequate Implementation of PESA: The implementation of PESA has been uneven and lackluster. Many states have not framed appropriate rules, leading to poor self-governance and inadequate empowerment of Gram Sabhas.
  2. Land Alienation and Displacement: Tribals continue to face issues of land alienation and displacement due to large-scale industrial projects, mining, and infrastructure development, often without adequate compensation or rehabilitation.
  3. Administrative Apathy: There is often a lack of administrative will and awareness among officials about the special provisions and rights of Scheduled Areas, leading to poor governance.
  4. Exploitation and Human Rights Violations: Tribals in these areas frequently face exploitation, human rights abuses, and socio-economic marginalization. Illegal mining, deforestation, and forced evictions are common issues.
  5. Insufficient Development and Infrastructure: Despite special schemes, Scheduled Areas often lag in basic infrastructure such as healthcare, education, roads, and sanitation due to inadequate implementation and corruption.
  6. Conflict and Insurgency: Many Scheduled Areas are affected by left-wing extremism (Naxalism), which hampers development initiatives and creates a cycle of violence and underdevelopment.

Case Studies

  1. Jharkhand: Despite being rich in minerals, Jharkhand's tribal population faces severe displacement and land alienation due to mining activities. The implementation of PESA remains weak.
  2. Chhattisgarh: In regions like Bastar, tribal communities suffer from both left-wing extremism and displacement due to industrial projects. The lack of proper governance and development exacerbates their plight.

Way Forward

  1. Strengthening PESA Implementation: States should frame comprehensive rules for PESA and ensure its effective implementation, empowering Gram Sabhas and local governance.
  2. Protecting Tribal Land Rights: Strict enforcement of laws to prevent land alienation and ensure fair compensation and rehabilitation for displaced tribals.
  3. Enhancing Administrative Capacities: Training and sensitizing officials about the special provisions and rights related to Scheduled Areas.
  4. Focused Development Initiatives: Implementing targeted development schemes with transparency and accountability to improve infrastructure and socio-economic conditions.
  5. Addressing Conflict: Integrating development efforts with peace-building measures in conflict-affected areas, ensuring the participation of tribal communities in the process.

Conclusion

The Fifth Schedule aims to protect and promote the interests of tribal communities in Scheduled Areas. However, significant challenges remain in terms of implementation, land rights, development, and governance. A committed and coordinated effort from both central and state governments is essential to address these issues, ensuring that the constitutional provisions fulfill their intended purpose of uplifting and empowering tribal populations.
