Introduction: Under Article 93 of constitution of India provides for  Speaker of the Lok Sabha, he plays a pivotal role in ensuring the smooth and effective functioning of the parliamentary system. The Speaker's office is considered to be the guardian of the rights and privileges of the members of the house, and the custodian of the dignity and decorum of the house.

Crucial Role of the Speaker:

    1. Presiding Officer: The Speaker presides over the sittings of the house, maintains order, and ensures adherence to the rules and procedures of the house.
    2. Guardian of Rights: The Speaker protects the rights and privileges of members of the house and ensures that their voices are heard and their concerns are addressed.
    3. Interpreter of Rules: The Speaker interprets the rules of procedure and the constitution in a fair and impartial manner, ensuring that the proceedings are conducted in accordance with the law.
    4. Certify whether a bill as money bill or not
  • Chair the joint sitting of parliament
  1. Facilitator of Debate: The Speaker encourages healthy and constructive debate, allowing all members to express their views freely and without fear of intimidation or harassment.
  2. Neutral Arbiter: The Speaker acts as a neutral arbiter in disputes between members, ensuring that everyone gets a fair hearing and that justice is done.

Importance of Impartiality and Independence:

  1. Fairness and Justice: Impartiality ensures that all members are treated equally and that decisions are taken on the basis of merit and not on the basis of political affiliation.
  2. Credibility and Trust: Independence from political influence is crucial for maintaining the credibility and trust of the Speaker's office. This is essential for ensuring that the members have faith in the Speaker's decisions and rulings.
  3. Effective Functioning: A Speaker who is perceived to be biassed or influenced by political considerations will not be able to command the respect and cooperation of all members. This will hamper the effective functioning of the house.
  4. Upholding Democracy: An impartial and independent Speaker is a pillar of democracy, ensuring that the legislature functions in a transparent, accountable, and democratic manner.

How to ensure the neutrality and impartiality of the speaker

  1. Election Process Reforms:
    • Cross-Party Consensus: Encourage a convention where the ruling and opposition parties reach a consensus on the Speaker candidate, ensuring broader acceptance and reducing partisan bias.
    • Secret Ballot: Always conduct the election through a secret ballot, even if there is only one candidate, to protect the anonymity of members' votes and reduce potential pressure.
    • Fixed Term: Consider establishing a fixed term for the Speaker, independent of the Lok Sabha's term, to minimise political considerations in their removal.
  2. Code of Conduct:
    • Impartiality: Formulate a strict code of conduct emphasizing the Speaker's impartiality and neutrality in all proceedings.
    • Transparency: Mandate the Speaker to provide clear and reasoned explanations for their rulings, ensuring transparency and accountability.
    • Recusal: Require the Speaker to recuse themselves from matters where they may have a conflict of interest, ensuring fairness and objectivity.
  3. Powers and Discretion:
    • Curbing Disqualification Powers: Limit the Speaker's discretionary power to disqualify members under the anti-defection law. Establish a clear and objective criteria for such decisions.
    • Independent Panel: Consider establishing an independent panel of experts to review and advise the Speaker on complex or controversial matters, promoting informed and impartial decision-making.

Conclusion:

  • The role of the Speaker in Indian parliamentary democracy is both challenging and crucial. The Speaker must not only be knowledgeable about the rules and procedures of the house, but also possess the wisdom, tact, and impartiality to deal with complex issues and situations.
  • It is essential that the Speaker remains above the political fray and acts as a neutral arbiter, upholding the principles of fairness, justice, and democracy. Only then can the Speaker truly serve as the guardian of the house and ensure its effective functioning.
