UNCTAD Trade and Development Report 2026: India Leads Global Greenfield Investment (2020–25)

India Leads in Greenfield Investment

  • UNCTAD’s Trade and Development Report 2026 shows India’s share of global greenfield investment during 2020–25 was 5.7%, more than double China’s 2.8%.
  • The report notes that strategic sectors now draw a rising share of greenfield investment, but this investment remains concentrated in Europe and North America.
  • It also describes India as the fastest-growing major economy, even though domestic consumption is showing strain from higher prices.

Core Facts

  • Greenfield investment means a company sets up a new venture (factory, plant or facility) in a foreign country, rather than buying an existing firm.
  • The share of strategic sectors in global greenfield investment rose from 16% to 44% between 2020 and 2025.
  • AI infrastructure attracted the largest share, followed by the semiconductor value chain and energy transition technologies and services.
  • Strategic investment is concentrated in Europe and North America, which is an integration challenge for the Global South, especially Least Developed Countries.
  • Within developing economies, capital mainly flows to developing Asia, led by China, India, Indonesia, Malaysia and Singapore.
  • India ranks third in the number of industrial policies adopted over 2008–21, behind only China and the USA.

MP High Court Strikes Down 27% OBC Reservation Law

Madhya Pradesh High Court Ruling

  • On 9 October 2026, the Madhya Pradesh High Court struck down the law increasing OBC reservation from 14% to 27%.

  • It held that OBCs are adequately represented in public employment under Article 16(4).

ConceptStatic Points for Prelims
Article 16(4)Lets the State reserve posts for backward classes not adequately represented in services. It is an enabling provision, not a fundamental right.
Article 15(4) and 15(5)Allow special provisions for SEBCs, SCs and STs, including in educational institutions (15(5) added by the 93rd Amendment, 2005).
50% ceiling and creamy layerBoth come from Indra Sawhney (1992). The ceiling can be crossed only in “extraordinary situations” backed by data. The creamy layer excludes advanced OBCs.
Maratha quota caseJaishri Laxmanrao Patil (2021) struck down the Maratha quota for breaching the 50% ceiling.
EWS quotaThe 103rd Amendment (2019) added 10% EWS reservation, upheld in Janhit Abhiyan (2022).
Article 340Allows the President to appoint a Commission on backward classes. The Mandal Commission (1979) was set up under it.
Article 338B and 342AThe 102nd Amendment (2018) gave constitutional status to the NCBC and the President’s power to notify SEBCs. The 105th Amendment (2021) restored State power to identify SEBCs.
Ninth ScheduleProtects laws like Tamil Nadu’s 69% quota, but they remain open to judicial review (I.R. Coelho, 2007).

Important Facts

  • The 50% ceiling is a judicial rule, not a constitutional text.
  • Adequacy of representation is the constitutional test under Article 16(4). It is judged on quantifiable data, not on population share alone.
  • Courts have held that under-filled quota posts are an administrative failure and cannot, by themselves, justify a higher quota.
  • Article 16(4A) (77th Amendment, 1995) allows reservation in promotions for SCs and STs. Article 16(4B) allows carry-forward of unfilled vacancies.
  • Article 16(1) guarantees equality of opportunity in public employment, and Article 16(2) bars discrimination on grounds of religion, race, caste, sex, descent, place of birth or residence.
  • The judgment applies to public service appointments and does not change the SC (16%) and ST (20%) quotas.
